Court Upholds Legality of Bus Search!

HARRISBURG The legally tangled issue of whether police may randomly board and search commercial buses for illegal drugs became more clouded this week as a Superior Court panel upheld the legality of a search at a King of Prussia bus terminal.
The three-judge panel made a distinction between searches at the Interstate 80 toll plaza at the Delaware Water Gap, which the Superior Court had previously found unconstitutional, and searches at terminals and regularly scheduled stops, where passengers customarily leave or board buses.In a 2-1 ruling, the majority said searches conducted during a scheduled stop amount to "a mere encounter" with police in which citizens have no obligation to cooperate or answer questions, and those do not constitute an "investigative detention." The opinion, written by Judge Corry Stevens, also concluded that the conduct of the two state drug agents was within the bounds of the law.Click the above link for the full article!
