Though he said he "can have the utmost sympathy" for their plight, a Cobourg judge said Monday he has no authority to return seized marijuana to three men who say it was legally grown for them locally as medicine.However, Justice Rhys Morgan told Marc Paquette, Robert Neron and Don Appleby they may be able to apply to Cobourg's Ontario Court of Justice for the pot once Dianne Bruce's preliminary inquiry is over. 
The Cramahe Township woman is scheduled to appear in the Cobourg court on February 6, 2002, on nine charges, including possession of a substance, production of a substance and possession for the purpose of trafficking.The charges stem from a Northumberland OPP raid at Ms. Bruce's Cramahe Township home on October 19, 2001. Court heard Monday that 18 kilograms of marijuana was seized.At that time of the raid, Ms. Bruce was growing pot for at least 50 pot exemptees from across Canada, including Mr. Paquette of Hawkesbury, Mr. Neron of Hearst and Mr. Appleby of Ottawa.The three men attended court at Victoria Hall Monday with some supporters bearing signs and a pot plant. They applied, under a section of the Controlled Drugs and Substances Act (CDSA), to get the seized marijuana or be financially compensated for the cost of the pot."We're very sick," Mr. Paquette, who walked with a cane, told court. "We just want our medication back.""Do something for us," Mr. Neron, who appeared in court wearing a neck brace, told the judge. "You have the power to do something for us."But Justice Morgan sided with the federal Crown who stated the seized marijuana, under the CDSA, is currently evidence for Ms. Bruce's upcoming preliminary inquiry and can be kept as such.Mr. Paquette, who told court he is dying and has been trying since last October to get the seized marijuana, said after the ruling he had "lost time.""We're all sick and dying people and the court system... they don't help us," he said.Earlier Monday, Mr. Paquette said outside court that he was "here to claim my marijuana which is my legal medicine since March 24, 2000."He said he has a lengthy list of ailments and the government hasn't helped with the exemptees' supply of the medication."They leave us to deal with organized crime," Mr. Paquette said. "The Government puts us in terrible danger by doing so."In June of 2001, Mr. Paquette gave his permission, along with at least 50 other legal exemptees from across Canada, for Ms. Bruce to grow the marijuana for them."They were too sick or too poor to buy the equipment because we have absolutely no help from no governments and this will have to change," Mr. Paquette said."Today I am coming here to make a claim on what Dianne Bruce was growing for me."In court, Justice Morgan stated Mr. Paquette and the other applicants may be permitted to use marijuana medically but that "doesn't mean that Ms. Bruce has the licence to grow it."Mr. Paquette explained that, in his original exemption from Canadian pot laws, nothing was stated that someone else couldn't grow the marjiuana for him.As a result, Ms. Bruce was legally growing it for him, Mr. Paquette told court.In August 2000, Mr. Paquette noted, the government came out with new laws that make it too strict for any of the exemptees to grow the marijuana."Since I have my legal exemption I still have to buy on the street at my risk," Mr. Paquette said."I often get fooled by quality and prices are very high. It costs me $1,200 a month on a $1,500-a-month disability pension and I'm fed up (with living) like that. It's not a life," he said outside court."I need better care and better treatment from the Government to help me out to pay for my marijuana; to get it for free or at a reasonable price," he said.Court heard there is a facility in Flin Flon, Man., licensed by Ottawa to grow medical marijuana.But the applicants told court of repeated problems in getting the marijuana distributed to them."I'm undermedicated because of the system," Mr. Neron told court. He stated the government can legally supply him with medication, including "heroin patches by the box," but "can't provide me with the medication of my choice."Justice Morgan also wondered if he had the authority to deal with the applicants. I can't get it to post, Dang newfangled junk!
FoM, I cannot get the dang thing to post here from cc forums but it's the picture with Brett and Rock w/ nappy sativa's in foreground. Can see my babies behind them on ground, was few month's ago before they were what you see now. They did pretty well from looks of things. Will have Jason post on our website tonight or morning latest, will put link to site here. Hope everything is sane in your neck of woods. Steve Tuck

Are those the same plants they showed in Cannabis Culture? They have really taken off! They looked weak & lanky when Canada's Health Minister was "inspecting" the mine. Thanks puff_tuff!
