A single marijuana seed on a car seat is enough to justify a search of the vehicle, according to a state appellate court.The ruling by the 9th District Court, released yesterday, stemmed from the Dec. 13, 1997, arrest of Brian Zimmerman, 19, of Seville, who was pulled over in a routine traffic stop and arrested after marijuana and drug paraphernalia were found in his vehicle.
The case was thrown out in February 1998 when Medina County Common Pleas Judge James L. Kimbler ruled that sheriff's deputies had no justification to call for a K-9 and search the car, which had been stopped for a missing front license plate.Kimbler's decision was reversed by a unanimous decision of the three-judge appellate panel, which ruled that a marijuana seed spotted on the front seat by a deputy, coupled with Zimmerman's unsteady demeanor, provided ``reasonable suspicion'' to warrant a search.Where will this all end?
