California Pot Grower Won't Face Local Prosecution

No state charges will be filed against a man who claimed he grew 38 marijuana plants in his garden for medical reasons. The San Bernardino County district attorney's office informed local police last week that it would not prosecute David Fawcett.Authorities determined that Fawcett was meeting conditions of Proposition 215, the state measure that allows people to have marijuana if a doctor states they need it for medical purposes, prosecutor Richard Maxwell said.
A letter from his doctor said Fawcett needed the drug to combat shingles, severe depression and other problems.State law against possession of marijuana "doesn't apply to him," and there was no indication that he was selling the drug, which also is illegal, Maxwell said.However, Fawcett still faces federal prosecution. The U.S. Drug Enforcement Administration opened a case against him, Ontario police Detective Mike Macias said.Fawcett, who has a 1999 felony conviction for marijuana cultivation, was arrested on May 22 and the plants in his backyard garden were seized."It's all well and good that they dropped the charges, but they have ruined my life again," Fawcett told the Inland Valley Daily Bulletin. "They took all my plants, and I don't think they're going to return them. It still has to be tried in California...
Something that garners between 73-85% of popular support will inevitably lead to some jury nullification...hint - when the citizen jurists of California exercise their RIGHT to DESSENT and judge the LAW as well as the accused, it will come, a might swift end to damnable prohibition.

don'tcha love double jeopardy???
i'm a native and citizen of california...i'm not so sure iwant to add U.S. citizenship...that pile of marble over 3000miles away is inflicting cruel and unusual punishment oncalifornians...ya think running the FBI and the federalattorneys out of california might be a good idea?(think about the boston tea party, 3000 miles from london...)
